1. PRIZE: The winner of this prize, if there is a winner, will be solely responsible for any federal, state or local taxes, title, delivery, insurance and travel related to the contest and prize.
2. GRANT OF RIGHTS: By submitting an Entry, each Entrant agrees and hereby grants to FFS, Sponsors and their successors, licensees and assigns an unlimited, perpetual, irrevocable, assignable, royalty-free, fully paid-up license to reproduce, distribute, perform, create derivative works of, edit, alter, display, exhibit, combine with other materials, exploit and otherwise use the Submission, and all elements embodied therein, including, without limitation, the names and likenesses of any persons embodied therein, in any manner and in any and all media now known or hereafter devised throughout the universe for any purpose whatsoever, including, without limitation, for commercial purposes, without compensation or notification to, or permission from, Entrant or any third party and hereby waives any moral rights in the Submission. Without limiting the generality of the foregoing, Entrant agrees that the FSS is not responsible for any unauthorized use of Submissions by third parties and that FSS will have no obligation to make any use whatsoever of the Submission and they may not post, take down and/or cease using any Submission for any reason or for no reason at any time in their sole discretion.
3. PUBLICITY RELEASE: Acceptance of a prize constitutes each Winner's permission for the FSS and their respective designees to use Winner's name, photograph, likeness, caption, voice, biographical information, statements and city and state (collectively, the "Attributes"), for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter devised, in perpetuity, without further compensation, notification or authorization (except where prohibited by law), and each Winner releases FSS from all claims arising out of the use of such Attributes.
4. LIMITATION OF LIABILITY: Fulltime Fantasy Sports LLC and its affiliates ("FFS") are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of Entries, the announcement of the prizes or in any Contest-related materials. FFS is also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. FFS is not responsible for injury or damage to any person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website.
Entrants hereby release, discharge and hold harmless FFS from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from participation in the Contest or any Contest-related activity or the acceptance, possession, use or misuse of any awarded prize (including any travel/activity related thereto).
